Book Description

This book – a companion to Peter Barnes’ book on the sub-contract for the JCT 2005 Standard Building Contract, The JCT 05 Standard Building Sub-Contract – covers the other eight current JCT sub-contracts:

· the Design and Build Sub-Contract

· the Major Project Sub-Contract

· the Intermediate Sub-Contract

· the Intermediate Sub-Contract with sub-contractor’s design

· the Intermediate Named Sub-Contract

· the Minor Works Sub-Contract with sub-contractor’s design

· the Short Form of Sub-Contract

· the Sub-subcontract

Like the sub-contract for the JCT 2005 Standard Building Contract, these forms are not well covered by other books on building contracts, despite the importance of specialist contractors and the size and value of their work.

This book considers a range of key issues, including questions of time, variations, loss and expense, and payment, and examines how these operate under the individual sub-contracts.

It will be of interest not only to sub-contractors and main contractors, but also to construction professionals and lawyers.

Editorial Reviews

Review

“I found this book to be eminently readable and extremely interesting … .This book could well become a necessity.” (Expert and Dispute Resolver, Winter 2008)

From the Author

One of the co-authors of this book (Peter Barnes) has already written a book on the `JCT 05 Standard Building Sub-Contract’, and this latest book now deals with all of the other JCT 05 subcontracts that have been published up to the date of publication of this book. The construction industry is almost entirely dependant upon subcontractors, and on nearly all construction projects a vast majority of the work is carried out by subcontractors. Despite this, traditionally, the contract terms relating to subcontractors have not been given the same consideration as the contract terms in the employer / main contractor relationship. Possibly because of this, there is a clear shortage of books that deal with contract law in the context of subcontracts, and it is principally because of the above that Peter Barnes and Matthew Davies decided that a book should be provided that recognised the role that subcontractors play in the construction industry. This book is written in a manner that is easy to follow as a working manual, but also provides analysis of legal matters that are relevant to a subcontractor’s rights and obligations.
